1. Services
Next Day Delivery*
-Nextday deliveries will be completed the following business day, they must be called in by 4:30pm and ready to be picked up the following morning. Next day service does not include weekend or holidays. Saturday delivery is available upon request at an additional charge
Same Day Delivery*
-All same day deliveries must be called in and ready to pick up by 11am and will be delivered by 5pm.
3 Hour Delivery*
-All 3 hour deliveries must be called in and ready to pick up by 1pm (will be delivered in 3 hours after pickup)
Rush Delivery*
-Rush deliveries must be called in by 2pm and will be delivered within 2 hours of pickup, a surcharge will apply to rush deliveries called after 2pm
After Hours Delivery*
-The shipper can call Locate Transportation Logistics at anytime of their intent to have a shipment picked up or delivered after hours.
-The shipper will then be advised the service availability depending destination and will be quoted the price at that time.
-Will be picked up and delivered outside of Locate Transportation Logistics Regular hours (8am-5pm)
*Please note for deliveries requested Monday through Friday between the hours of 5pm-7am the rate charged may be subject to an after-hour premium. Any deliveries requested 12am-11:59pm Saturday and Sunday may be subject to an after-hour premium.
2. Liability
Locate Transportation Logistics is not responsible for any lost, stolen, or damaged items once they have been delivered
3. Surcharges
surcharges may apply for the following:
3.1 A minimum of $10 will apply to all “non-pickups”
3.2 Maximum weight for cars is 100 pounds, additional weight is 15 cents per pound
Maximum weight for a minivan is 1000lbs, additional weight is 15 cents per pound
3.3 A “Waiting Time Charge” may be applied when a Locate Transportation Logistics driver has to wait for either a pick up or delivery of a shipment. A surcharge of 50 cents per minute will apply (First 10 minutes n/c, however any time of 15 minutes will be charged).
3.4 Quoted rates include 1 piece up to 30lbs. Additional items are $2 per piece or weight surcharge.
3.5 A surcharge may be applied to shipments to courthouses, hospitals, colleges and universities
3.6 A 10% surcharge will be applied to all Rush shipments to the GTA after 2pm
3.7 After Hours Charge:
An additional premium is applicable for each package/order with a required pickup or delivery time outside Locate Transportation Logistics regular operating hours. Locate Transportation Logistics regular hours are; but not restricted to; Weekdays from 8:00am to 5pm excluding Statutory Holidays. These hours are subject to change without notice. The Shipper must inform an Locate Transportation Logistics representative during regular operating hours of their intent to have a shipment picked up or delivered after hours. The shipper will then be advised the service availability depending destination and will be quoted the price at that time. The shipper is also responsible for providing Locate Transportation Logistics with the contact information of a person also available during the times requested of the order in the event of an unexpected issue.
3.8 Freight-Collect or Third Party Billing Charge:
This charge only applies to domestic shipments. An additional charge may be assessed when a Shipper requires Locate Transportation Logistics to invoice a third party or the consignee. Either/or must have an Locate Transportation Logistic account. The shipper must inform a customer service representative at the time of placing the order, of their request either freight-collect or third party billing. The Shipper must also mark the waybill appropriately. The Shipper agrees to pay for the service and any charges associated in the event the consignee or the third party fails to pay the invoice. Locate Transportation Logistics reserves the right to place the customers on a cash only basis as well as any other legal rights and remedies available to it.
3.9 Redirect Charge (Address Correction Charge):
If Locate Transportation Logistics is unable to deliver any shipments because of an incomplete or incorrect address; Locate Transportation will make reasonable efforts in locating the correct address. If the correct address is located, the Shipper will be notified of the correction on their delivery service bill. An additional fee, set forth in the Locate Transportation Logistics Pricing applicable to the Shipment in effect at the time of shipping, will be assessed to each Package within the Shipment for this service.
3.10 Future Charges:
Rates, charges terms and conditions and services are subject to change without notice. The most current rates, terms and conditions and services may be obtained online at www.locatelogistics.ca
4. Invoicing/payment terms
- An invoice will be issued the day the delivery is completed
-Upon receiving the invoice,the customer is given up to 60 days to pay the invoice after which a late payment surcharge may apply.
-Invoice/Billing discrepancies must be brought to Locate Transportation Logistics attention within 90 days of the date of the invoice, after which time such invoice will be deemed accepted by the customer.
-Overdue balances are subject to interest calculated at ten percent (10%) per month which will accrue and be payable on all outstanding balances.
-A minimum of $10 charge will apply to all non-pickups
4.1 Return Payments
An administrative fee will be applied on any payment that is dishonoured for any reason, including a payment returned due to Non-Sufficient Funds (NSF). The customer agrees to reimburse Locate Transportation Logistics for all costs, including legal fees and bank charges, incurred as a result of late or dishonoured payments.
4.2 Payment for Service
Locate Transportation Logistics credit terms require payment of all charges upon receipt of Locate Transportation Logistics invoice. The Shipper agrees to pay Locate Transportation Logistics all shipping charges in the event of nonpayment by the Consignee or the alternative party invoiced. In the event the customers fails to pay the invoice, Locate Transportation Logistics reserves the right to place the customer on a "cash only" basis as well as implementing any other legal rights and remedies available to it.
5. Payment Method Options
Visa, Mastercard, Discover, American Express, E-Transfer, Interact, Cheque, Cash
6. Currency
Unless expressly noted to the contrary, all monetary amounts are stated and shall be paid in Canadian currency.
7. Liability for Loss, Damage or Delay
7.1 Locate Transportation Logistics shall have no liability for loss or damage of shipments once the package is delivered
7.2 The carrier shall be relieved of all if such loss, damage or delay arises from the effect of of:
7.3 Delay. Locate Transportation Logistics does not guarantee its delivery times, and shall not be liable for any loss or damages suffered as a result of the failure to deliver a shipment by a stipulated time of day, even if it is aware of such consequences when the shipment originates.
8. Confidentiality
All prices and/or agreed upon services exclusively pertain to one merchant and/or business. Prices and/or agreed upon services may not reflect all business schedules.
9. Refusal of Shipments
Locate Transportation Logistics reserves the right to refuse any package that by reason of the dangerous nature or any other character of it’s contents liable, in judgement of Locate Transportation Logistics, to soil, taint, or otherwise damage other merchandise or equipment, or that is economically or operationally, impracticable to transport, or that is improperly packaged, wrapped, or labeled.
10. Labeling
Every package tendered to Locate Transportation Logistics must contain a complete From and To details including postal code, contact names, telephone number and signatures, Locate Transportation Logistics cannot deliver to a P.O Box. Shipments require a street address including apartment/suite/unit numbers and the consignee's telephone number. Multiple-piece shipments must be labeled with the full delivery address on each piece and each piece individually marked 1 of 3, 2 of 3, 3 of 3, etc.
11. C.O.D Service
For COD (Cash on Delivery) shipments, when instructions are provided by the Shipper in writing to Locate Transportation Logistics to collect bank drafts, certified cheques, money orders or similar instruments at time of delivery, Locate Transportation Logistics will do so in return for the Shipper paying a special fee to Locate Transportation Logistics. If the Shipper requires payment in cash only for the COD, Locate Transportation Logistics reserves the right to collect payment instead by bank draft, certified cheque, money order or similar instrument. All bank drafts, certified cheques, money orders, and cash will be accepted by Locate Transportation Logistics from the receiver/consignee at the Shipper’s risk, including, but not limited to the risk of forgery of the monetary instrument or non-payment there under, and Locate Transportation Logistics shall not be liable upon any such instrument. Locate Transportation Logistics will typically send to the Shipper, within 10 days of the delivery of the COD shipment, the form of instrument collected by Locate Transportation Logistics from the receiver/consignee. In no event, however, will Locate Transportation Logistics be liable to the Shipper for a COD amount for more than the value of the shipment, or $1,000, whichever is less. The entry of a COD amount by the Shipper is not a Declared Value.
12. Rounding Measurements
Shipment dimensions must be rounded up to the closest whole inch. Shipment weights must be rounded up to the next whole pound.
13. Return of Undeliverable packages
Shipments which are sent "prepaid" by the Shipper and which are refused by the Consignee or which for any other reason cannot be delivered, will be promptly returned to the Shipper with an additional charge being billed to and paid for by the Shipper. Shipments which are sent "collect" or "third party" by the Shipper and which are refused by the Consignee, or which for any other reason cannot be delivered, shall be promptly returned to the Shipper with all shipping and additional charges billed to and paid for by the Shipper. If the returned Package is refused by the Shipper, or the Package cannot otherwise be returned to the Shipper, Locate Transportation Logistics will retain the Package for a period of time determined at its sole discretion, but no more than thirty (30) days, and Locate Transportation Logistics reserves the right to dispose of the Package thereafter.
14. Proof of Delivery (P.O.D)
Delivery can be verified by calling or emailing Locate Transportation Logistics.
15. Verbal Proof of Delivery
Verbal confirmation of delivery is available to both the Shipper and Consignee. The proof of delivery will consist of the name of the person who signed for the Shipment, the time and date the Shipment was delivered.
16. Taxes
All applicable Federal and Provincial taxes required by law will be charged on all freight costs and surcharges. The customer agrees to pay Locate Transportation Logistics any and all taxes assessed to their account.
17. Service Guarantee
In the event Locate Transportation Logistics fails to complete delivery or attempt delivery, within the time commitment, Locate Transportation Logistics, at its option, will reduce the charges to the next appropriate service level either by credit or refund for each such shipment, to the payer only, upon request, subject to the following conditions:
18. Terms and Conditions of Guarantee
The service guarantee for on-time delivery is subject to the following conditions: Locate Transportation Logistics guaranteed delivery schedule must state that the destination point qualifies for the service commitment from the origin point. The Shipment must be properly documented on an Locate Transportation Logistics pick up record and each Package in the Shipment must bear the appropriate Locate Transportation Logistics waybill. Each package in the Shipment must be properly labeled, including From/To address details, with the Consignee’s correct name, deliverable address, postal code, and telephone number. Locate Transportation Logistics will not deliver to a P.O. Box. For Next day, Sameday, 3-hour, Rush, and After Hours services, the appropriate information must be recorded on the waybill and Locate Transportation Logistics must be made aware of the required service at the time of order.
19. Limits & Restrictions
The on-time delivery guarantee does not apply to shipments which are delayed due to causes beyond Locate Transportation Logistics control including, but not limited to the following; the unavailability or refusal of a person to accept delivery of the Shipment, delays caused by the Consignee, acts of God, the Queen’s or public enemies, public authorities acting with actual or apparent authority on the premise, acts or omissions of customs or similar authorities, riots, circumstances arising before, during, or after a strike or other labour disputes, civil commotions, disruptions in the air or ground transportation network(such as weather phenomena), authority of law, defect or inherent vice in the goods shipped, and nuclear reaction, radiation or radioactive contamination and natural disasters. The on-time delivery guarantee does not apply to Packages subject to any Package exceeding Maximum Weight and Size Limits or containing articles listed as a Prohibited Article or any Dangerous Goods Shipment. The on-time guarantee does not apply to shipments picked up from or delivered to certain extended points deemed to be Beyond Points.
20. Termination
20.1 Either party may terminate this Agreement at any time, without
cause, by giving thirty (30) calendar days’ written Notice to the other.
20.2 Either party may immediately terminate this Agreement upon written Notice to the other party if at any time during the Term:
a) either party ceases to carry on business or makes a sale in bulk of all or substantially all of its assets; or
b) either party becomes insolvent or bankrupt, or les any proposal or makes any assignment for the bene t of creditors; or
d) an order is made for the winding-up or liquidation of either party; or
20.3 Should the customer fail to purchase Products and Services under this Agreement for a period of more than twelve (12) consecutive months, Locate Transportation Logistics may terminate the Agreement or amend the list of Authorized Users without notice.
20.4 Termination of this Agreement shall be without prejudice to any rights of the customer or Locate Transportation Logistics that have accrued prior to the date of termination.
20.5 Neither party shall have a right to damages as a result of termination of this Agreement.
21. Waiver
Any failure or delay by Locate Transportation Logistics in enforcing or applying any provision of these General Terms and Conditions shall not constitute a waiver of that provision or otherwise impair Locate Transportation Logistics’ right to enforce or apply such provision or any other provision in the future.
22. Definitions
“Business Day” means a day other than Saturday, Sunday, a statutory holiday and any day normally observed as a holiday by Canada Post.
“Next day Delivery” means Locate Transportation Logistics will deliver you package within 24 hours of pickup
“Same day Delivery” means Locate Transportation Logistics will deliver your package the day of pickup by 5pm
“3-hour Delivery” means Locate Transportation Logistics will deliver your package within 3 hours from being picked-up.
“Rush Delivery” means Locate Transportation Logistics will deliver your package within 2 hours from being picked-up
“After Hour Delivery” means Locate Transportation Logistics will pick up and deliver your package outside of regular operating hours
“Non-Pickup” means Locate Transportation Logistics attempted to pick-up or deliver a shipment and the shipment or the customer is not available, hence, pick-up or delivery is not affected. In this case a, non-pickup surcharge will be applied.
“Freight Collect” means that the person or company that receives goods will pay the cost of transporting the goods at the time they are received.
